Annulment

An annulment ends a marriage upon determining a legal marriage never occurred.

Every case is very different, but an action for annulment is rare. Annulments will only be granted under the following circumstances:

  • the marriage was based on fraud or a substantial misrepresentation,
  • the couple was forced into a marriage,
  • one of the parties was married to another person and never obtained a divorce,
  • one of the parties lacked the capacity to enter into marriage, or
  • one or both of the parties were underage.
