An annulment ends a marriage upon determining a legal marriage never occurred.
Every case is very different, but an action for annulment is rare. Annulments will only be granted under the following circumstances:
- the marriage was based on fraud or a substantial misrepresentation,
- the couple was forced into a marriage,
- one of the parties was married to another person and never obtained a divorce,
- one of the parties lacked the capacity to enter into marriage, or
- one or both of the parties were underage.
