Attorney Outlines Recent COA Decision: Major Victory for Associations and Property Managers

Joe Wloszek_8x10@300Joe Wloszek, an attorney in our Livonia office, recently wrote an article on the potential consequences of a co-owner slipping and falling on a condominium premises.  The article was published in the Michigan Chapter of the Community Associations Institute’s publication Community Association News.

In “What Happens When Someone Slips and Falls on Condominium Property?” Mr. Wloszek highlights a recently published Michigan Court of Appeals decision that determined a co-owner who slipped and fell on an icy, snow-covered sidewalk, resulting in severe injuries, cannot receive damages from his association or its property manager for breach of contract or negligence.  This is a major victory for associations and property managers in Michigan and represents significant protection in their favor.  Co-owners should be aware of the repercussions of this case and exercise additional caution on condominium premises.
